Description of Services
We provide a gateway software (EggKey Gateway) to our providers which will give to wireless users access to the Internet through a browsing environment that allows the user, to “surf” the Internet without divulging your personal information to web site hosts or advertisers. In short, EggKey Gateway filters your requests to access a web site or retrieve information from a web site before being disseminated to the Internet. Thus, web site hosts and advertisers typically do not see your identity, but instead see the identity of the EggKey's Provider. Accordingly, your requests will typically appear as though they are coming from the EggKey Access provider. This may help to protect the end-user privacy and to prevent advertisers from monitoring and tracking your Internet preferences and habits.
Control of Content
We provide EggKey Gateway as a service to our providers. By using EggKey Gateway, you agree that we have the right, but not the obligation, to monitor all content, including but not limited to data, photographs, video or messages, sent or received by you. You agree that we may, at our sole discretion, refuse access to any content that we determine to be objectionable or which otherwise violates the rights of others. You further agree that we may copy, record, or store any content sent or received by you while using EggKey Gateway. When required by lawful court order, this information may also be provided to certain third parties. These third parties may include appropriate governmental or law enforcement authorities, federal regulatory agencies and others as necessary to provide the service requested or to assist in the investigation of fraud, harassment or any other unlawful activity.
Online Payments
When performing payments on-line using one of our partners (PayPal.com or 2Checkout.com), the users have to read their terms of services and agree with them. EggKey.com will not be responsible for any damaged or loss caused by a misunderstood transaction.
Termination
We reserve the right to terminate your access to EggKey Gateway with or without cause and without providing notice to you prior to termination. Such termination may be done solely at our discretion.
Limited Right to Use
To use EggKey.com Gateway, you must agree to the following:
- EggKey.com Gateway shall not be used for sending commercial email solicitations or advertisements (SPAM).
- EggKey.com Gateway shall not be used to obtain unauthorized access; or to intentionally crash, slow, or otherwise harm any computer system.
- EggKey.com Gateway shall not be used to harass, threaten or harm others, including minors.
- EggKey.com Gateway shall not be used to impersonate any person or entity.
- EggKey.com Gateway shall not be used to invade the privacy of others.
- EggKey.com Gateway shall not be used to infringe any intellectual property rights of others.
- EggKey.com Gateway shall not be used in furtherance of criminal activity.
- EggKey.com Gateway shall not be accessed using any automated system or using repeated high speed requests.
- EggKey.com Gateway shall not be used to purchase merchandise with fraudulent credit cards or numbers.
- EggKey.com Gateway shall not be used to interfere with others' use and enjoyment of this service.
So long as all of these conditions are met, EggKey.com will take all reasonable and legal measures to ensure the anonymity of the users using this service. Abusers of this policy will be dealt with appropriately.
Liability for the Services is Limited
EggKey.com and EggKey Gateway are provided "as is" and without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Neither EggKey.com nor any of it's officers, directors, agents, Subsidiaries, affiliates, employees, successors, assigns, content providers or service providers will be liable for any indirect, incidental, special or consequential damages arising out of use of EggKey.com Gateway, or inability to gain access to or use EggKey.com Gateway. EggKey.com will not be liable for any material or web sites accessed through the EggKey.com Gateway or for information contained in or part of the EggKey.com Proxy Server.
